A new state law, effective September 12, 2026, makes it easier for homeowners in planned communities to install backyard shade structures. Here’s what you need to know about your rights under A.R.S. 33-1816.01.

What does the new Arizona shade law do?

The law prevents HOAs in planned communities from completely banning the installation of professionally manufactured shade structures. While your HOA can still enforce reasonable design rules, they cannot have a blanket prohibition against qualifying projects.

What types of shade structures are covered?

Professionally manufactured and installed products designed to provide shade are protected, including:

  • Awnings and Pergolas
  • Canopies and Gazebos
  • Shade Sails and Umbrellas

Do I still need HOA approval?

Yes. You must still obtain written approval from your HOA before installation. The new law ensures you have the right to submit an application and that it cannot be denied based on a complete ban. Your HOA can still require compliance with its design standards and local building codes.

What can my HOA not do under the new law?
